If You don't comprehend any of the followings Terms And Conditions, have a question or need an explanation, be sure that you contact us before proceeding with any reservation. This User Agreement and its performance shall be governed by the laws of England and Wales without regard to conflict of laws provisions that would result in the application of the laws of any other jurisdiction. If a dispute arises between You and clickairporttransfer.com You agree to submit to the exclusive jurisdiction of the English courts. We regret that it is not possible to make a reservation if these Terms and Conditions are not accepted in full.
1 Contract Formation
1.1 clickairporttransfer.com acts as an agent between You and third party transportation service providers. The contract for the provision of the transportation service is between You and the third party service provider, not between You and clickairporttransfer.com.
1.2 If you make a reservation on clickairporttransfer.com, You agree to enter into a contract with the actual transportation service provider that operates the requested route and not with clickairporttransfer.com .
1.3 When You submit Your reservation request on clickairporttransfer.com , Your booking details are sent to the transportation service provider. Only when the transportation service provider accepts Your reservation, the contract between You and the transportation service provider is actually formed. You will be advised by email once the transportation service provider accepts Your reservation.
2.1 The liability for the provision of services between You and the transportation service provider is restricted exclusively to those two parties between whom the service has been contracted. Clickairporttransfer.com liabilities that result from this agreement shall therefore be limited to those of a third-party broker between You and the transportation service provider. Any liabilities that result from the provision of the requested service shall be the exclusive responsibility of the transportation service provider.
2.2 Based on our knowledge, all the transportation service providers utilized by clickairporttransfer.com are fully licensed and insured, bound to the laws imposed by their country of operation. Some of the transportation service providers may limit or exclude liability totally or in part according to the laws and licensing rules which change from one country to another. We advise the customers to purchase an adequate travel insurance to protect themselves and their properties throughout the trip.
2.3 Clickairporttransfer.com and transportation service provider will not be responsible for any losses, including, but not limited to, lost properties, stolen, lost or damaged luggage, missed flights, ferries, trains or any other missed connecting service, due to whatsoever reason.
2.4 According to this User Agreement, You accept that clickairporttransfer.com will in no way be held responsible for any losses, expenses, direct or indirect damages that arise from the use or missed use of the booked transportation services, under any normal or particular condition, even if You have warned clickairporttransfer.com about particular circumstances affecting Your trip. All claims will be laid with the service provider.
3 Availability of Service
3.1 We are entitled, on behalf of the service provider, to reject any booking made by You. We do not guarantee to successfully allocate a transportation service provider to every reservation request. If we are unable to assign Your reservation request to a transportation service provider accepting Your booking, we will send You an email offering different options.
3.2 Information written into www. clickairporttransfer.com web site are reported as a courtesy service for web site visitors and customers, we cannot be held responsible for any inaccuracy or error.
3.3 Except for VIP and Business Class transfers, vehicle model, type, features and accessories indicated in the reservation form and on the web site, shall not be considered integral part of the contract and both Click Airport Transfer or service provider may change the assigned vehicle or its accessories without previous notice, should this be necessary in order to provide the transport. Once the vehicle is boarded You accept the provided service in full and no further complains or requests for compensations apply. In case You do not accept the provided vehicle or its accessories, service will be canceled and no compensations apply (cancellation penalties may be applied at Click Airport Transfer or service provider's discretion). Should you be interested in VIP or Business Class transfers, guaranteeing particular vehicles or accessories, please contact Click Airport Transfer for options and pricing.
4.1 The normal form of payment is by cash to the driver once You meet him/her at the arranged pickup location, unless a different form of payment was agreed to beforehand.
4.2 The credit card supplied during the booking process is used to validate and secure Your reservation, but it is not actually charged, unless You have requested a payment in advance. A "no show" fee will be charged to the credit card number indicated if You fail to cancel Your trip according to the terms explained later in this User Agreement.
4.3 Advanced payments by credit or debit cards are processed through PayPal and are subject to an additional processing fee. Credit card holders are subject to security checks and authorization from the credit card issuer.
4.4 You confirm that all the data supplied by Yourself on the reservation form is correct, true and valid. You confirm that the credit card supplied during the booking process is Yours and that it contains adequate funds to cover the price of the reservation service.
5 Cancellations or modifications
5.1 You may cancel Your booking with the followings cancellation fees:
a) No charge will be applied up to 5 (five) hours before the agreed pickup time.
b) 50% of the transfer's price will be charged, less than 5 (five) hours before the arranged pickup time, but before the driver has departed to the agreed pickup location.
c) 100% of the transfer's price will be charged after the driver has departed to the arranged pickup location or in case of "no show".
5.2 Maximum waiting time
a) Pick up from airports and cruise terminals: 60 minutes from actual flight or cruise ship arrival time (as displayed on airport / cruise terminal information monitors). After this time, if you do not communicate with the driver, he/she will consider it as a "no show", and the driver will leave the arranged pickup location and a cancellation fee (100% of the booked service's price) will be charged.
b) Pick up from any other location: 30 minutes from the arranged pick up time. After this time, if you do not communicate with the driver, he/she will consider it as a "no show", and the driver will leave the agreed pickup location. A cancellation fee (100% of the booked service's price) will be charged.
5.3 In case of "no show" without any communication from You, after the maximum waiting period has ended, the entire cost of the reservation transfer will be charged.
5.4 Any change to Your booking must be notified to us in writing form by email, within 48 hours before the arranged pickup time. Once You receive the service provider contact number by email, generally 48 hours before the scheduled pickup time, any change to Your reservation must be arranged directly with the driver by calling the phone number indicated on the email.
5.5 If we have to cancel Your booking, we will inform You as soon as possible via email, suggesting, if possible, any applicable alternative options.
5.6 We reserve the rights to cancel any reservation for whatsoever reason. No compensations are due, except for a full refund in case Your reservation was paid in advance.
6 Child safety seat
As from EU directive 2003 / 20 / EC the followings rules apply:
6.1 Children must use the correct child safety seat until they are 135cm tall or 12 years old (whichever occurs first). They must always wear an adult seatbelt. The driver is responsible for checking if children are restrained correctly. However, there is an exemption for licensed vehicles, which can still carry children even if the correct child safety seat is not available.
6.2 Children under 3 years of age, with or without a child safety seat, are calculated towards the vehicle occupancy.
7 Excess luggage and special items
7.1 In order to ensure best service and to make sure that a car with correct size will be assigned to You, be sure that you inform us about any excess luggage or special items (oddly shaped, heavy or bigger than normal, including, but not limited to: wheelchairs, scuba dive equipment, bikes, strollers, etc.). You will be liable for all the incurred expenses for additional or different vehicles, required to transport the luggage not specified on the booking form.
8 Force Majeure
8.1 Clickairporttransfer.com and the service provider cannot be held liable for delays, modifications or cancellation of service caused by unforeseeable circumstances beyond the service provider's control, such as accidents suffered by third parties on the transfer route, normal or abnormal traffic, strikes, acts of terrorism, police checkpoints, extreme weather conditions, natural disasters, detours, road maintenance, etc.
9 Copyright and Intellectual Property Rights
9.1 Copyright, trademarks and other intellectual properties of the web site have been granted under license to clickairporttransfer.com and are protected by national and international laws on intellectual property.
9.2 Use of our web site's content by third parties for any purpose other than reservation services is forbidden. This includes changes, reverse-engineering, reproduction in total or in part, publication or representation of the same without the express authorization of clickairporttransfer.com
